Nick Shirley, a conservative YouTuber, has filed a federal lawsuit against the state of California, challenging Assembly Bill 2624. This law, signed by Governor Gavin Newsom, expands privacy protections for those providing immigration-related services, but has been dubbed the "Stop Nick Shirley Act" by Republican lawmakers. Shirley, represented by the America First Legal Foundation, claims the law infringes on First Amendment rights and could hinder reporting on immigration service providers.
The lawsuit, filed in the U.S. District Court for the Eastern District of California, targets California Attorney General Rob Bonta and Secretary of State Shirley Weber. It argues that AB 2624 unlawfully targets journalists and citizens investigating immigration-related organizations, violating the First Amendment and the Due Process Clause of the Fourteenth Amendment. The law, which becomes operative on October 1, 2027, restricts the publication of personal information about immigration service providers, allowing for civil lawsuits and takedown demands over posted information.
According to America First Legal, Shirley's investigative work has exposed significant fraud in various sectors, including Somali-run daycare centers in Minnesota and California. The law is seen by some as a response to his reporting, which has led to closures of taxpayer-funded businesses involved in fraudulent activities.
The law has sparked controversy, with Republican legislators arguing it stifles free press protections. GOP Assemblymember Carl DeMaio criticized the legislation, claiming it aims to intimidate journalists like Shirley. However, supporters of the law, including Assemblymember Gail Pellerin, argue it protects individuals from harassment and threats.
As the legal battle unfolds, Shirley and his supporters continue to advocate for transparency and accountability in government spending and immigration services.
