California Governor Gavin Newsom's defamation lawsuit against Fox News is scheduled for trial in March 2028. The case, which centers on a June 2025 phone call between Newsom and President Donald Trump, alleges that Fox News misreported the call, portraying Newsom as dishonest. This trial could coincide with Newsom's potential presidential campaign.
The lawsuit, filed in Delaware where Fox News is incorporated, seeks $787 million in damages. Newsom accuses Fox News of distorting facts about a phone call related to federal immigration raids in Los Angeles. Fox News host Jesse Watters initially claimed Newsom lied about the call, but later apologized. Despite attempts by Fox News to dismiss the case, a Delaware judge has set the trial date for March 6, 2028.
The case enters the discovery phase, with subpoenas issued to Newsom's advisors for documents related to the call and Fox News's coverage. Newsom's lawyer, Michael Teter, stated that "the truth matters" and emphasized holding Fox accountable. Fox News, however, maintains that the lawsuit lacks merit and violates First Amendment protections.
If the trial proceeds, it could impact Newsom's campaign. Loyola Law School professor Jessica Levinson noted that the timing might serve as a talking point for Newsom or lead to a request to reschedule the trial. As the case unfolds, both parties may consider settlement options.
